Welcome to Thambili Tours. These Terms & Conditions govern your use of https://thambilitours.com and your interactions with us regarding travel planning and travel-related services in Sri Lanka.

By using this website, you agree to these Terms & Conditions. If you do not agree, please discontinue use of the website.

1. About Thambili Tours

Thambili Tours aims to help travellers discover Sri Lanka through personalised journeys, sample itineraries, and selected travel services.

Depending on the request, we may assist with itinerary planning and coordinate services such as accommodation, transport, guides, excursions, cultural experiences, nature activities, and wildlife experiences.

The services available for a particular trip will be described in the relevant quotation or written booking confirmation.

2. Website Information and Sample Journeys

The website may display sample itineraries, destinations, experiences, photographs, descriptions, and travel inspiration.

These materials are intended to help you explore possible travel options. Unless expressly stated otherwise:

  • Sample itineraries are illustrative, not guaranteed packages.
  • Routes, travel times, accommodation, and activities may be adjusted to suit your requirements.
  • Photographs and descriptions may be representative of an experience rather than a guarantee of the exact setting, room, view, or conditions.
  • Published content does not guarantee availability, supplier participation, or a particular travel outcome.

We aim to keep website information accurate and current but may correct errors or update content when necessary.

3. Travel Inquiries and Quotations

Submitting an inquiry does not create a confirmed booking or oblige either party to proceed.

After receiving your inquiry, we may discuss your preferences, prepare a proposed itinerary, check supplier availability, and provide a quotation.

A quotation may specify:

  • Travel dates and itinerary.
  • Number of travellers and accommodation arrangements.
  • Included and excluded services.
  • Price, currency, taxes, and applicable charges.
  • Payment schedule and booking requirements.
  • Cancellation, amendment, and refund conditions.
  • Validity period and other relevant restrictions.

Unless expressly stated otherwise in writing, a quotation is a proposal and not a confirmed reservation. Prices and availability may change before the relevant arrangements are confirmed.

4. Booking Confirmation

A booking is confirmed only when the applicable acceptance requirements stated in the quotation or booking documents have been satisfied and Thambili Tours has issued written confirmation.

Depending on the arrangement, this may require acceptance of the itinerary and terms, receipt of the required payment, and confirmation by relevant suppliers.

A supplier's availability indication or a draft itinerary does not by itself establish a confirmed reservation.

5. Prices and Payments

The applicable quotation or booking confirmation will specify the price, currency, payment method, due dates, and any deposit or balance requirements.

Unless otherwise stated in the applicable booking documents:

  • Prices may depend on travel dates, traveller numbers, room arrangements, supplier rates, and availability.
  • Additional services or changes requested after confirmation may result in additional charges.
  • A quotation does not include services expressly listed as excluded.
  • Bank charges, currency-conversion costs, taxes, and other charges will be handled as stated in the relevant quotation or applicable law.

Do not assume that a booking is confirmed merely because a payment has been initiated. Confirmation will be provided in writing.

6. Changes to Travel Arrangements

You should notify us as soon as possible if you need to change your travel dates, traveller details, accommodation, itinerary, or requested services.

We will assess the requested change and, where possible, coordinate it with the relevant suppliers.

Changes may be subject to availability, price differences, supplier approval, amendment fees, or cancellation charges. Any applicable charges and revised arrangements will be communicated before the change is accepted, where reasonably practicable.

Changes cannot be guaranteed, particularly where suppliers have already confirmed or delivered services.

7. Cancellations and Refunds

Cancellation rights, refund eligibility, deadlines, and applicable charges depend on the specific services booked, the supplier's conditions, the timing of cancellation, and applicable law.

The cancellation and refund terms applicable to your booking must be provided in the relevant quotation or booking documents before you commit to the booking.

If you wish to cancel, contact us in writing as soon as possible. We will explain the applicable process and any supplier charges or amounts refundable under the agreed terms.

No universal cancellation fee, refund percentage, or refund deadline is established by these website Terms alone. Any applicable booking-specific terms must be clearly communicated and must not override rights that cannot lawfully be excluded.

8. Third-Party Travel Suppliers

Some travel services are delivered by independent third-party suppliers, including accommodation providers, transport operators, guides, and activity providers.

Their own conditions, safety requirements, availability, and operating practices may apply.

Thambili Tours will communicate relevant supplier conditions that apply to your arrangements. The responsibility of Thambili Tours and any supplier will depend on the services contracted, the relevant booking documents, and applicable law.

Nothing in these Terms excludes liability or consumer rights where such exclusion is prohibited by law.

9. Travel Conditions and Itinerary Changes

Travel involves factors that may be outside anyone's control, including weather, road conditions, wildlife behaviour, public events, transport disruptions, government restrictions, and changes to supplier operations.

We will make reasonable efforts to communicate material changes and help coordinate practical alternatives where possible. Alternative arrangements may affect the itinerary, cost, or duration of a trip.

Wildlife sightings, weather conditions, travel times, and access to specific attractions cannot be guaranteed.

10. Traveller Responsibilities

Travellers are responsible for:

  • Providing accurate booking information and promptly reporting relevant changes.
  • Ensuring that passports, visas, entry permissions, and other required documents are valid.
  • Reviewing official travel advice and complying with local laws.
  • Following reasonable safety instructions from guides, drivers, and activity providers.
  • Disclosing relevant requirements or limitations where necessary to arrange a service safely.
  • Arriving at agreed meeting points at the stated times.
  • Respecting local communities, cultural practices, wildlife, and the natural environment.

Please inform us in advance of accessibility requirements, dietary needs, or other arrangements that may affect the suitability of a proposed experience.

11. Health, Safety, and Travel Insurance

Some activities may involve physical exertion, uneven terrain, water, wildlife, remote areas, or other inherent risks.

You should consider whether each activity is suitable for your circumstances and follow the instructions of the relevant provider.

We strongly recommend appropriate travel insurance covering relevant medical expenses, emergency assistance, personal belongings, cancellations, and disruptions. Any specific insurance requirement will be stated in the applicable booking documents.

Unless expressly agreed in writing, Thambili Tours does not provide insurance to travellers.

12. Responsible Travel

We encourage travellers to respect Sri Lanka's natural environment, wildlife, cultural heritage, and local communities.

Travellers should follow site rules, avoid disturbing wildlife, respect religious and cultural locations, and minimise unnecessary environmental impact.

Descriptions of responsible travel intentions are not a guarantee that every supplier or activity meets a particular certification or environmental standard.

13. Website Use and Intellectual Property

Unless otherwise indicated, the website's original text, branding, design, and other materials are owned by or used with permission by Thambili Tours or the relevant rights holder.

You may browse the website and use its content for personal travel-planning purposes.

You must not, without appropriate permission:

  • Reproduce or commercially exploit website content.
  • Copy branding, photographs, or other protected materials.
  • Interfere with website security or operation.
  • Use automated methods to abuse or disrupt the website.
  • Submit unlawful, fraudulent, or misleading information.

Third-party names, trademarks, and materials remain the property of their respective owners.

14. Website Availability and Accuracy

We aim to keep the website accessible and useful, but uninterrupted availability cannot be guaranteed. Maintenance, technical problems, security issues, or circumstances outside our control may affect access.

We may modify, suspend, or remove website content where necessary. This does not cancel obligations arising under an already confirmed booking.

15. Liability

To the extent permitted by applicable law, Thambili Tours is not responsible for losses caused solely by inaccurate information supplied by a traveller, a traveller's failure to comply with communicated requirements, or events outside our reasonable control.

This clause does not exclude or restrict liability for fraud, wilful misconduct, negligence, breach of a legal duty, or any other liability that cannot lawfully be excluded or restricted.

Any additional limitations of liability applicable to a particular trip must be set out clearly in the relevant booking documents and reviewed for legal enforceability.

16. Privacy

Personal information is handled in accordance with our Privacy Policy, available on the Thambili Tours website.

By submitting an inquiry, you acknowledge that we need to process relevant information to respond to your request. Any additional consent required by applicable law will be obtained separately where appropriate.

17. Complaints and Support

If you have a question or concern about a proposed or confirmed arrangement, please contact us using the details below and provide your booking reference, if available.

We will review the matter and seek to respond within a reasonable time. Emergency contact and on-trip support arrangements will be provided with the relevant confirmed itinerary where applicable.

18. Governing Law

These Terms are intended to be governed by the laws of Sri Lanka, subject to any mandatory consumer protection or other legal rights that apply in the traveller's jurisdiction.

Any dispute will be handled by the competent courts or dispute-resolution mechanisms determined under applicable law. Nothing in this section removes a right that cannot lawfully be waived.

19. Changes to These Terms

We may update these Terms when our website or services change. The updated version will be published on this page with a revised date.

The version applicable to a confirmed booking will be determined by the booking documents and applicable law. We will not rely on a later website update to remove rights already granted under a binding agreement.
